Physicians Pay Out On Case Claiming Medical Mistake Resulted in Infant’s Erb’s Palsy Injury

A type of lawsuit frequently encountered by a birth injury attorney involves an Erb’s palsy injury. This kind of injury can leave a baby with a permanently disabled arm.

When evaluating these cases an erbs palsy lawyer considers various factors. Among the concerns is if the doctor had knowledge indicating there may be difficulties with a vaginal delivery and took adequate actions to eliminate them.

In a documented case, for example, the child’s mother had earlier delivered two additional children both of whom had been born large . The mother was recorded as being borderline for gestational diabetes in the fourth month of her pregnancy. She had disroportionate weight gain in the pregnancy. The baby had been documented larger than expected at four months of pregnancy and to be in the ninetieth percentile for weight. Her physicians scheduled her for induced vaginal labor in the fortieth week of pregnancy.

Once admitted to the hospital for the scheduled vaginal delivery various troubling indications were noticed. However, the doctor did not try to examine the pregnant woman one more time for gestational diabetes or to approximate the unborn child’s weight ahead of inducing her. The doctor did not alter the plan and do a C-section.

Hospital documents revealed that shoulder dystocia was found and that subsequent to delivery of the child’s head, as opposed to using a routinely applied technique, the doctor just employed suprapubic pressure to facilitate delivery. The child was ten pounds 10 ounces and had a head circumference in the 90th percentile. The baby had Erb’s palsy. As she got older her arm atrophied due to her inability to use it. She has developmental delays and she has cerebral palsy. According to law firm that represented the family reported that the case settled for $900,000.

The preceeding is not medical or legal advice. You ought to check with a physician at once in the event you believe there is a problem with your pregnancy or your baby has a health problem. Consult a medical negligence lawyer should you believe your baby was harmed as a result of an error by a doctor or other well being care professional.
